DOL Proposes Delay of Implementation of Final Rule that will Increase Wages under H-1B and PERM Categories

On March 22, 2021, the U.S. Department of Labor (DOL) announced a proposed delay in the implementation of the Final Rule Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States, initially published in the Federal Register on January 14, 2021. This Final Rule amends regulations that control the computation of wage levels under the DOL’s four-tier wage structure, which determines prevailing wage levels as they apply to employment-based nonimmigrant visas such as H-1B, H-1B1, and E-3, as well as under the PERM category for immigrant visas. DOL is proposing that this Final Rule effective date be delayed eighteen months, or to November 14, 2022. More information regarding this recent Federal Register notice by the DOL can be found here.
